MotoCMS.com provides online digital products available for purchase, product descriptions, product images, product samples and other digital content. With the exception of any portion of the MotoCMS products, you may download, view, copy and print any other aspect of this site, (i) solely for personal, informational, and non-commercial purposes; and (ii) provided that neither the materials, nor any proprietary notices therein, are modified or altered. You agree not to upload on or transmit to or via MotoCMS.com any content which: (i) infringes or otherwise violates any copyright, patent, trademark, trade secret or any other proprietary right; (ii) is defamatory, libelous, expresses hate, or is unlawfully threatening; (iii) is pornographic, obscene or exploitative of a minor; (iv) contains or embodies a virus, worm, Trojan Horse or other contaminating or destructive feature; or (v) otherwise violates any applicable treaty, law or regulation.
You agree you will not interfere, in any way, with others’ use of, or access to MotoCMS.com and will not attempt to gain unauthorized access to the account or computer system of any other MotoCMS.com site user. You further agree not to take any other action in connection with your use of MotoCMS.com which violates any treaty, law or regulation and to fully comply with all applicable treaties, laws and regulations in your use of MotoCMS.com. MotoCMS.com assumes no liability, and shall not be held responsible for, any action you take in connection with your use of MotoCMS.com.
License
Our website grants you two possible types of license to use the website templates and other products (the “products”) sold through our website by independent content providers in accordance with these Terms and Conditions (the “license”) issued by our company, as follows:
LIFETIME USAGE LICENSE
You may be granted a Lifetime Usage License in case of purchasing a website template in terms of the Lifetime Plan. It enables you to use each individual product on a single website only, belonging to either you or your client. You have to purchase the same template again if you are to use the same design in connection with another or other projects;
YEARLY SUBSCRIPTION PLAN
You may be granted a Yearly Subscription License in case of purchasing a website template in terms of a Yearly Plan. This License is provided for a period of one (1) year. You acknowledge, agree, and authorize us to bill the applicable fee or charge your credit card or other payment methods on file automatically up to fourteen (14) days prior to the end of each Renewal Period, unless you terminate or cancel the Subscription prior to the charge. Upon failure to bill the applicable fee, the License will not be extended for the next year, and all User Content will be removed within 14 days since License expiration.
IMAGERY, CLIPARTS AND FONTS
All imagery, clipart, fonts and video footages used in our products are royalty-free and are the integral part of our products. One Time Usage License gives you the right to use images, clipart, fonts and video footages only as a part of the website you build using your template. You can use imagery, clipart, fonts and video footages to develop one project only. Any kind of separate usage or distribution is strictly prohibited. All images and illustrations used in templates come in a single layer, as is.
MODIFICATIONS
You are authorized to make necessary modification(s) to our products to fit your purposes in accordance with the type of license you acquire.
UNAUTHORIZED USE
If you have not received the Buyout License, you shall not place any of our products, modified or unmodified, on a CD, website or any other medium. You also shall not offer them for redistribution or resale of any kind without prior written consent from our company.
ASSIGNABILITY
You shall not sub-license, assign, or transfer the any mentioned above to any entity without prior written consent from our company.
SUPPORT
You are granted with free technical support for the purchased MotoCMS product for the term of your License.
SYSTEM UPDATES
MotoCMS 3 system is updated with new functionality on a regular basis. When purchasing any MotoCMS 3 Product, you get free access to the system updates for the term of your License.
With a Yearly Subscription Plan, you get updates for one year. Future updates of the purchased product are provided for additional payment. Upon purchasing a Lifetime License, you get free lifetime updates.
User Content
Except where otherwise expressly provided by MotoCMS.com, all comments, feedback, or information submitted to MotoCMS.com through or in association with MotoCMS.com (collectively, “User Content”) will be considered non-confidential and MotoCMS.com property. By submitting such User Content to MotoCMS.com, you agree that you assign to MotoCMS.com, without charge, all worldwide rights, title and interest, including copyrights and other intellectual property rights, in and to the User Content. MotoCMS.com will be free to use such User Content in any manner or media whatsoever, on an unrestricted basis and without any compensation or royalties to you.
You also represent and warrant that you own or otherwise control all of the rights to the User Content that you post; that the User Content is accurate; and that use of the User Content you supply does not violate this policy and will not cause injury to any person or entity. MotoCMS.com has the right but not the obligation to monitor and edit or remove User Content. MotoCMS.com takes no responsibility and assumes no liability for any User Content posted by you or any third party.
Google Analytics
MotoCMS can collect certain information about the client using the MotoCMS 3 website builder to improve user interaction with the admin panel. The data collection is anonymous, and no personal information is collected.
What information do we collect?
The length of time a user spends viewing a specific section of the admin panel. This time metric helps us to understand the user engagement with different sections of the admin panel.
Antifraud check
Customer purchase can be suspended for manual antifraud check for 10-20 minutes as well as it can be suspended for longer term (around 20 hours) for more serious investigation. Antifraud check occurs because of growing number of fraud transactions from persons who are not actual cardholders of the credit cards used during purchase.
Refunds
Since MotoCMS.com is offering non-tangible irrevocable products we do not issue refunds once the order is performed and the product is delivered, which you are responsible for understanding upon purchasing. Please make sure that you have carefully read all relevant documentation and tried out the demo.
However, we are aware that some circumstances can occur under which we are to review a refund request. With regard to the specific character of the product we provide, there are reasons, upon which a REFUND REQUEST can be applied:
- Non-delivery of the product: in case some mailing issues occur and an e-mail with a download link is not delivered to you, please contact us for assistance. Claims for non-delivery must be submitted to our Technical Support Team in writing within 7 days from the order placing date.
- Download and unzipping issues: in case you faced with the problems while downloading the product or its unzipping, you have to contact our Technical Support Team without any delay. If you do not contact us during this period, you agree that we may construe silence as a successful download of the product without further right of redress or refund for a “download issue” reason.
- Major bugs and defects: when you stably encounter an error which is preventing you from using our product properly, and if we are not able to correct the error within an acceptable period of time or are unable to suggest a temporary solution, the refund will be issued to the customer in full without any compensations. Such issues must be submitted to our Technical Support Team’s approval.
- Product not-as-described: such issues should be reported to our Technical Support Department within 7 days from the date of the purchase. Clear evidence must be provided proving that the purchased product is not as it is described on the website.
- Yearly Subscription Licence Order: a full, fourteen (14) day money-back guarantee is generally offered. Upon written notification of the Subscription License cancellation request within the first fourteen (14) days of Your original purchase of a Yearly Subscription, the fees that MotoCMS has received from you will be refunded. If within these fourteen (14) days you were provided with a domain name, a cancellation fee may be applied.

Some products and services provided by MotoCMS are not eligible for a refund. All purchases of the following types of products and services are final and non-refundable unless otherwise provided by law:
- All set-up fees in connection with Services, including but not limited to Installation and Template Customization services;
- All Services that are provided specifically and individually for your website, including but not limited to SEO Optimization, Web Copywriting, and Design services.

Complaints based on the absence of features which we never claimed to provide and which are not listed in the feature list for our product are not honored.
Please note, that we do not guarantee to save the content you create in the demo version of the template because of the possible issues that may occur on the server.
Please note, that we do not assume the responsibility and therefore reserve the right to refuse a refund request based on incompatibility of our products with some third-party software.
We will send you an e-mail to notify whether you are eligible for a refund based on the proof of purchase you provided and product package you returned to us (if any). You must also destroy all copies of the software you may have made or stored in any place, as well as remove the software from any computers owned or controlled by you.
If your request for a refund is confirmed, the money will be processed to your credit card account within 2 to 7 business days following confirmation of eligibility.
Chargebacks
If at any time, we record a chargeback or any other rejection of a charge of any payable Fees (“Chargeback”), this will be considered as a breach of your payment obligations hereunder, and your use of the MotoCMS Services may be automatically disabled or terminated.
In the event a Chargeback is performed, your License(s) may be blocked without the option to repurchase or reuse it, and any data, including any domains, User Content, and Services, may be subject to cancellation and Capacity Loss.
Our company reserves the right to change or modify the terms and conditions without prior notice.
